DENVER – Pork processor Triumph Foods confirmed on Aug. 7 that plaintiffs in the Brown v. JBS USA Foods lawsuit would petition the US District Court of Colorado to dismiss the case.

The original lawsuit was brought in November 2022, and alleged that beef and pork companies engaged in fixing and depressing employee wages.

Triumph said plaintiffs requested that all claims against Triumph should be dismissed with prejudice and they would cooperate with the plaintiffs as legal action continues against the remaining companies. 

Kenny Brinker, owner of Harrison Creek Farm and president of the board of directors for the Allied Producers’ Cooperative, a group of smaller Midwest farmers, provided a statement on the plaintiff request.

“These allegations were false and bring hardship to farmers and families like mine that worked hard to break out of the traditional market to create Triumph,” Brinker said.

The cooperative is one of the owners of Triumph Foods. 

Some of the other companies involved in the original lawsuit include Cargill Inc., Hormel Foods Corp., American Foods Group LLC, Seaboard Foods LLC, National Beef Packing Co. LLC, Smithfield Foods Inc., Agri Beef Co., Washington Beef LLC, Perdue Farms Inc. and Agri Stats Inc., among others.
