KANSAS CITY, Kan. – Two men were indicted on charges of allegedly selling misbranded and adulterated poultry products throughout the US, the Kansas City Star reported.

Craig Cunningham, general manager of The Hitchin Post Steak Co., Kansas City, Kan., and his son, Jason Cunningham, vice president, were named in an indictment returned Jan. 25. The indictment cites alleged incidents involving nearly 400,000 lbs. of product including split broiler chickens, chicken leg quarters and whole chicken wings between March and December 2008.

The Hitchin Post received slaughtered animals and processed them into products to ship to customers throughout the US, according to an indictment in the US District Court in Kansas City, Kan. The company operated primarily as a poultry processor starting in 2008.

The indictment alleges both men conspired to sell adulterated poultry products, which were misbranded because they allegedly were processed outside the approved hours of USDA inspection. Both men are also charged with unlawful use of a USDA inspection mark.

Incorporated in 1999, The Hitchin Post filed for Chapter 11 bankruptcy protection in 2009.

Craig Cunningham told MEATPOULTRY.com he couldn’t comment at this time and he planned to meet with his attorneys later this morning.
