The burger chain denied any wrongdoing in the class-action case.
 
MIAMI – Legal representatives of Burger King Corp. announced on Dec. 22 the company has agreed to a settlement of a class-action lawsuit that alleged some Burger King restaurants overcharged for the company’s Croissan’wich breakfast sandwich when customers redeemed a buy-one-get-one-free coupon. Eligible plaintiffs in the case are alleging they were charged too much for the sandwich when they ordered the items modified, which included without egg, cheese and/or a meat, between Oct. 1, 2015, and May 19, 2017, and used a coupon to receive one free of charge.

Burger King agreed to pay $5 payments as settlement or provide $2 gift cards to people submitting a valid claim form. The company, however, denied any wrongdoing and said, “the court has not decided who is right.”  

The deadline for filing a claim form for the payments is Jan. 19, 2018. A hearing in the case of Anderson v. Burger King Corp. will be held on April 3, 2018 to determine if the settlement is fair and to determine if fees of $185,000 should be approved as well as up to $10,000 in expenses and a $500 service award to the class representative.  Robbins Geller Rudman & Dowd LLP is representing the plaintiff in this matter

Objections to the settlement are due by March 13, 2018.
