The Louisville Metro Board of Zoning Adjustment on Jan. 11 unanimously approved JBS’ request for a permit to use the lot at 151 and 201 Cabel Street for parking refrigerated trucks. JBS had argued the company didn’t need a conditional use permit, however, the Butchertown Neighborhood Association successfully argued in court that a permit was required.
The permit “to allow a potentially hazardous or nuisance use” includes conditions that require trucks to meet California emissions standards — described as the strictest in the United States. Other conditions include installation of an acoustic fence, landscaping to buffer noise from the trucks; a route that bypasses residences along Cabel during certain hours and other improvements that protect the health and welfare of nearby residents.
JBS Swift has 18 months to comply with the conditions of the permit.
