Sanderson Farms sues NLRB

LAUREL, Miss. – Sanderson Farms Inc. sued the National Labor Relations Board (NLRB) alleging the agency continued to pursue unfair labor practices charges against the company after the union that filed the complaint withdrew its case.
"The NLRB is prosecuting these charges without the consent and, until recently, the knowledge of seven of the employees and former employees named in the charges, without a justifiable claim for another former employee named in the charges and contrary to Local 693's request to withdraw its charges," according to the complaint.
The company said the Laborers' International Union of North America placed Local 693 in trusteeship in 2013. The trustee later found that the charges against Sanderson Farms were without merit, and tried to withdraw the complaint. Sanderson said in its complaint that the NLRB has not accepted the union's action to withdraw the complaint, actions that are in violation of the Administrative Procedure Act.
The case was filed US District Court for the Southern District of Mississippi.
